Terms

Sapien is a monthly journal of mentalism, published by Rado Sheytanoff and Chris Michael, who run it together as partners, at 1201 S Ross St #525S, Arlington, VA 22204, USA. These terms cover reading the site, subscribing, and buying a PDF, a printed copy or the goods. If anything here is unclear, write to editor@sapienjournal.com.

Who sells what

We do not take payments ourselves. Two companies sell for us as the merchant of record. That means they, not we, are the seller: they take the payment, charge any tax, send the receipt and deal with refunds.

Polar (Polar Software, Inc., polar.sh) sells the subscription and the PDF. Fourthwall (Fourthwall, Inc., fourthwall.com) sells the printed copy and the goods. Their buyer terms apply to the purchase and the payment. These terms apply to what you get from us: the issues, the PDF and the printed copy, and how you may use them. Fourthwall also makes and posts the goods.

Prices and tax

Prices are in US dollars. For the subscription and the PDF, the price shown includes VAT if you are in the EU, the UK or most other countries, and in the United States and Canada any sales tax is added at checkout. For the printed copy and the goods, VAT or sales tax is added at checkout. Every checkout shows the full price, with tax and postage, before you pay.

You need to be 18 or over to subscribe or buy.

The subscription

A subscription costs $7 a month or $70 a year. While it is active you can read every issue on the site, old and new, and download the PDF of each one from your account.

The subscription renews automatically until you cancel. You pay when you subscribe and then the same amount at the start of each new month or year. There is no minimum term. If you are on the yearly plan, we email you before each renewal with the date and the amount. If you are on the monthly plan, we email you once a year to remind you of the subscription, what it costs and how to cancel.

If the price ever changes, we email you before your first payment at the new price and tell you how to cancel. If you do not want to pay the new price, cancel before that payment.

Cancelling

You can cancel any time online: in your account, open billing and choose cancel. You do not have to call or write to anyone. If you cannot sign in, email editor@sapienjournal.com and we cancel it for you. You get an email confirming it.

When you cancel, nothing more is charged and you keep reading until the end of the month or year you have already paid for. After that, the issues on the site and the PDF downloads close. PDFs you already downloaded are yours to keep for your own use.

Your right to cancel within 14 days

If you live in the EU or the UK, the law usually lets you cancel an online purchase within 14 days without giving a reason. For the subscription and the PDF, you lose that right once you have access. At checkout you ask for access to start straight away, and you confirm that you understand you then lose the right to cancel within 14 days. We confirm both in the email we send after you pay.

Refunds

The prices are low, so we do not refund a subscription period or a PDF once you have access, or because you changed your mind. Polar may still decide to refund a payment under its own buyer terms.

This does not affect your rights under the law. If something you paid for does not work or is not as we described it, and we cannot put it right, you get your money back. If Sapien stops publishing, you get back the part of any period you paid for and did not get.

The PDF

The PDF of an issue costs $12, one payment, sold by Polar. It is ready to download from your account as soon as you pay, as often as you like.

The printed copy

A printed copy costs $28, plus postage of $6 to the United States and $12 anywhere else. It is sold by Fourthwall and printed for you by our printer, Lulu, after you order. Each copy is numbered, and the name you give us is typed into the colophon. If you leave the name empty, we use the name on the parcel. The PDF of the issue comes with it, in your account.

You can cancel the order within one hour of placing it, from your Fourthwall order page. After that the copy goes to print. Because each copy is personalized and made to your order, it cannot be returned because you changed your mind, and the 14 day right to cancel does not apply to it.

Printing usually takes three to five working days. The copy is then posted, tracked where the carrier offers it. Delivery times shown are the carrier’s estimates. If your copy arrives damaged or wrongly printed, send us a photo. If it has not arrived 30 days after you ordered, tell us. Either way, we send another copy or refund you, whichever you prefer.

In some countries the carrier may ask the recipient to pay import duty or tax on delivery.

The goods

The tee, crewneck, cap, mug and tote are sold, made to order and posted by Fourthwall, and Fourthwall’s returns policy applies to them. If something arrives damaged or faulty, report it to Fourthwall with photos within 30 days of delivery and they will replace it or refund you. If you live in the EU or the UK, you can also cancel within 14 days of receiving the goods without giving a reason, using the withdrawal option on your Fourthwall order page. You then pay the cost of sending them back unless Fourthwall says otherwise.

Your account

You sign in with a code we email you, so whoever controls your inbox controls your account. An account is for one person. Please do not share it. We may close an account that is shared or used to copy the journal. If we do, we tell you why and refund any part of a period you paid for and did not get.

What you can do with what you read

What you read in Sapien is for you. Read it, study it and perform what you learn. Do not copy, post, sell or share the articles, the methods, the PDF or the printed pages, in whole or in large part, and do not copy the site with scripts or other tools. The work belongs to the people who wrote it. The copyright page has the details.

You are responsible for how, where and to whom you perform what you learn here.

If something goes wrong

We work to keep the site up and the issues on time, but the site may sometimes be down or slow. If you live in the EU or the UK, you have legal rights when digital content or goods are faulty or not as described, and nothing in these terms takes them away.

We are not responsible for losses we could not have foreseen when you bought, or for business losses. Nothing in these terms limits our liability where the law does not allow it to be limited, such as for death or personal injury caused by negligence, or for fraud.

Changes

We may change these terms, for example when the law changes or we add something new. If a change matters to you, we email you before it takes effect. For a subscription, it applies from your next renewal, and you can cancel before then. A purchase is covered by the terms in force when you made it.

Law and disputes

Irish law governs these terms. If you live outside Ireland, you keep the protections that the law where you live gives you and that cannot be taken away by agreement, and you can bring a claim in the courts where you live or in Ireland.
